The agreement governing EcomVisual accounts, credits, subscriptions, AI content, and use of its product visual studios.

1. Acceptance of these terms
These Terms of Service (the "Terms") govern your use of ecomvisual.ai and the EcomVisual AI product visual studios (collectively, the "Service"). "EcomVisual", "we", "us", and "our" mean the operator of the Service.
By accessing or using the Service, creating an account, buying credits or a subscription, or submitting content, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.
2. The Service
EcomVisual provides AI-assisted tools that can create jewelry model photos, jewelry and fragrance product scenes, and, in supported workflows, short motion visuals from prompts and reference material. We may change, improve, limit, suspend, or discontinue a feature, model, output format, pricing option, or third-party integration at any time.
AI output is probabilistic. It may be inaccurate, incomplete, inconsistent, or unsuitable for your intended use. We do not promise that a result will match a prompt, preserve every product detail, meet a particular quality standard, be unique, or be legally or commercially suitable.
3. Eligibility and accounts
You must be at least 18 years old, or the age of legal majority where you live if higher, to use the Service. You must provide accurate account and payment information and keep it current.
You are responsible for safeguarding your credentials and for activity under your account. Do not share, sell, transfer, or make your account available to another person in a way that bypasses access controls, plan limits, or these Terms. Notify us promptly at support@ecomvisual.ai if you suspect unauthorized use.
4. Credits, subscriptions, and payment
The Service uses credits for generation tasks. The credit cost can vary by selected model, output type, resolution, duration, and other settings. The price, credits, and validity period displayed at checkout or in the applicable offer govern that purchase.
- Subscription fees are charged in advance for the selected billing period and renew automatically unless cancelled through the available billing flow.
- Subscription credits may expire at the end of the applicable paid period. Credit packs, promotional credits, and other grants may have different validity periods, which are shown in the relevant offer or account record.
- Promotional, trial, bonus, and free credits have no cash value and cannot be transferred, resold, or exchanged for money.
- You are responsible for applicable taxes, bank charges, exchange-rate differences, and payment-provider fees that are not included in the displayed price.
- We may change prices, credit costs, plans, or availability prospectively. A completed purchase remains subject to the price and offer presented at checkout, together with these Terms.
5. Cancellation and refunds
Where your payment provider and account support it, you may cancel a subscription from the billing area. Cancellation stops the next renewal; it does not automatically reverse a charge already paid or restore credits already consumed. Access and credits granted for the current period remain subject to the applicable plan, expiration date, and provider status.
Digital credits are made available immediately after purchase. Except where required by applicable law, fees and delivered credits are non-refundable. We may review a documented request for a duplicate charge, a confirmed system or payment-processing error, or an eligible failed generation task. A rejected prompt, user input error, changed preference, subjective dissatisfaction with an output, expired credit, or a chargeback does not by itself create a refund right.
When a generation fails because of a confirmed Service or provider error, we may reverse the credits consumed for that failed task. Do not initiate a chargeback for an issue that can be resolved through support; an open payment dispute may restrict our ability to process a separate adjustment.
6. Your content and permissions
"User Content" includes prompts, product images, model references, uploaded files, and other material you submit. You retain the rights you have in User Content. You grant us a limited, non-exclusive, worldwide license to host, reproduce, process, transmit, display, and store User Content only as needed to provide, secure, support, and improve the Service, enforce these Terms, and comply with law.
You represent that you have all required rights, permissions, releases, and consents for User Content and its use with the Service. This includes permission to use any recognizable person's likeness and any copyrighted, trademarked, or confidential material. You are responsible for reviewing generated outputs before publishing, advertising, listing, or otherwise relying on them.
7. Generated outputs and commercial use
As between you and EcomVisual, we do not claim ownership of the output we generate for you, subject to your compliance with these Terms and any rights held by third parties or our providers. Outputs may not be unique and may resemble material generated for other users.
You are responsible for determining whether an output is suitable for commercial use, product listings, advertising, marketplace publication, or another purpose. You must not represent an AI-generated visual as an authentic photograph, customer testimonial, endorsement, or real-person depiction when that would be deceptive. Make AI-generation disclosures where a platform, customer, or applicable law requires them.
8. Prohibited use
You must not use the Service to:
- Break the law; commit fraud; deceive, harass, threaten, stalk, or harm another person.
- Create, upload, request, or distribute child sexual abuse material or material that exploits minors.
- Create non-consensual intimate imagery, sexual deepfakes, or defamatory depictions of a real person.
- Promote terrorism, violent extremism, serious violence, self-harm, hatred, discrimination, or dehumanization of protected groups.
- Infringe copyright, trademark, privacy, publicity, or other third-party rights.
- Produce fake reviews, fabricated testimonials, counterfeit product evidence, or advertising that falsely implies an endorsement, purchase, or use by a real person.
- Upload or distribute malware, phishing, spam, credential theft, or harmful code.
- Scrape the Service, use unauthorized automation, bypass safety systems, rate limits, payment controls, authentication, or access restrictions.
- Resell, sublicense, redistribute, reverse engineer, or interfere with the Service without our written permission.
We may use automated filters, provider safety systems, rate limits, and manual review of reports or flagged activity. We may reject prompts, remove outputs, reverse or withhold credits where allowed, restrict access, suspend or terminate an account, and report serious violations when required or appropriate.
9. EcomVisual intellectual property
The Service, software, interface, branding, documentation, and other materials we provide are owned by EcomVisual or its licensors and are protected by intellectual-property laws. Subject to these Terms, we grant you a limited, revocable, non-transferable right to use the Service for its intended purpose. No other right is granted.
10. Third-party services
The Service relies on third parties for payment, authentication, storage, infrastructure, analytics, and AI processing. Their availability, policies, and terms may affect the Service. We are not responsible for third-party outages, delays, provider safety decisions, or changes outside our reasonable control.
11. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, created a security or legal risk, failed to pay, committed fraud, or tried to bypass platform controls. Termination does not affect provisions that should survive, including payment obligations, intellectual-property rights, disclaimers, liability limits, and indemnity.
12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED AVAILABILITY.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOMVISUAL AND ITS OPERATORS, LICENSORS, AND PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES.
OUR TOTAL LIABILITY FOR A CLAIM ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO ECOMVISUAL FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY, UNLESS APPLICABLE LAW REQUIRES A HIGHER AMOUNT.
14. Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless EcomVisual and its operators, licensors, and providers from claims, damages, losses, liabilities, and expenses arising from your User Content, your use of the Service, or your breach of these Terms or applicable law.
15. Changes and contact
We may update these Terms from time to time. The updated Terms will be posted here with a revised effective date. Your continued use of the Service after the updated Terms take effect means you accept them, to the extent permitted by law.
